Release and Waiver of Liability Form for Minors Participating in Youth Programs - English

This Release and Waiver of Liability (the “release”) executed on ___________________________________ (date) by __________________ (“Parent/Guardian”) releases Earth Discovery Institute and Endangered Habitats Conservancy (“Nonprofits”), both Nonprofit corporations organized and existing under the laws of the State of California and each of its directors, officers, employees, and agents. The Parent/Guardian desires to register his or her child to participate in Nonprofits events and/or programs.

Parent/Guardian understands that he/she is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Parent/Guardian’s child’s participation in Nonprofits events or programs.

Waiver and Release: I, the Parent/Guardian, release and forever discharge and hold harmless Nonprofits and their successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from my child’s participation in Nonprofits events or programs. I understand and acknowledge that this Release discharges Nonprofits from any liability or claim that I may have against Nonprofits with respect to bodily injury, personal injury, illness, death, or property damage that may result from my child’s participation in Nonprofits events or programs.
Insurance: Further I understand that Nonprofits do not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of Nonprofits beyond what may be offered freely by Nonprofits in the event of injury or medical expenses incurred by my child.
Medical Treatment: I hereby Release and forever discharge Nonprofits from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my child’s participation in Nonprofits events or programs.
Assumption of Risk: Due to the nature of some program activities, I acknowledge that my child’s participation could involve risk of bodily injury, illness, death, property damage, or other risks associated with these activities, and I assume full responsibility for such, including those arising from travel to and from such activities. Specific risks include but are not limited to: drowning, snakebites, blindness resulting from exposure to milkweed sap, and exposure to coronavirus.
Photographic Release: I grant and convey to Nonprofits all right, title, and interests in any and all photographs, images, video, or audio recordings of my child or my child’s likeness or voice made by Nonprofits in connection with my participation in Nonprofits events or programs.
Other: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected. By signing below, I express my understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily.

Este liberación y exención de responsabilidad (liberación) ejecutada el _____________________ (fecha) por __________________ (nombre del padre, madre, o guardián legal) absuelve la responsabilidad de Earth Discovery Institute y Endangered Habitats Conservancy ("Organizaciones sin fines de lucro"), ambas corporaciones sin fines de lucro organizadas y existentes por las leyes del Estado de California, y cada uno de sus directores, funcionarios, empleados y agentes. El padre/madre/guardián legal desea inscribir a su hijo/a para participar en eventos y/o programas de los organizaciones sin fines de lucro.

El padre/la madre/el guardián legal entiende que él/ella es responsable de su propia cobertura de seguro en caso de lesión personal o enfermedad que ocurre como un resultado de la participación del hijo/a del padre/la madre/el guardián en eventos o programas de los organizaciones sin fines de lucro.

Liberación y Exención: Yo, el padre/la madre/el guardián legal, libero a los ambos organizaciones sin fines de lucro y a sus agentes, empleados y voluntarios de cualquier responsabilidad, reclamo y demanda de cualquier tipo, ya sea en derecho o en equidad, que podria pasar como resultado de la participacion de mi hijo/a en los eventos y/o programas de los organizaciones sin fines de lucro. Entiendo y reconozco que este descargo de responsabilidad libera a las organizaciones sin fines de lucro de cualquier responsabilidad o reclamo que pueda tener contra las organizaciones sin fines de lucro con respecto a lesiones corporales, lesiones personales, enfermedades, muerte o daños a la propiedad que puedan resultar de la participación de mi hijo en eventos o programas de las organizaciones sin fines de lucro.
Seguro: Además, entiendo que las organizaciones sin fines de lucro no asumen ninguna responsabilidad ni obligación de brindarme asistencia financiera o de otro tipo, incluidos, entre otros, beneficios o seguros médicos, de salud o por discapacidad. Renuncio expresamente a cualquier reclamo de compensación o responsabilidad por parte de los organizaciones sin fines de lucro más de lo que las organizaciones sin fines de lucro pueden ofrecer libremente en caso de lesiones o gastos médicos incurridos por mi hijo/a.
Tratamiento Médico: Por la presente libero y libero para siempre a las organizaciones sin fines de lucro de cualquier reclamo que surja o pueda surgir en el futuro a causa de cualquier tratamiento de primeros auxilios u otros servicios médicos prestados en relación con una emergencia durante la participación de mi hijo/a en eventos o programas de las organizaciones sin fines de lucro.
Asunción de Riesgo: Debido a la naturaleza de algunas actividades del programa, reconozco que la participación de mi hijo/a podría implicar riesgo de lesión corporal, enfermedad, muerte, daño a la propiedad u otros riesgos asociados con estas actividades, y asumo toda la responsabilidad por ello/a, incluidos los que surjan de viajes hacia y desde dichas actividades. Algunos de los riesgos específicos incluyen: ahogamiento, mordeduras de serpientes, ceguera por exposición a la savia del algodoncillo y exposición al coronavirus.
Liberación Fotográfica: Doy mi consentimiento para que las organizaciones sin fines de lucro tengan todos los derechos, títulos e intereses en todas y cada una de las fotografías, imágenes, videos o grabaciones de audio de mi hijo/a o la imagen o la voz de mi hijo/a realizadas por las organizaciones sin fines de lucro en relación con mi participación en los eventos o programas de las organizaciones sin fines de lucro.
Más: Acepto expresamente que esta liberación tiene la intención de ser tan amplia e inclusiva como lo permitan las leyes del Estado de California y que esta Liberación se regirá e interpretará de acuerdo con las leyes del Estado de California. Acepto que en el caso de que alguna cláusula o disposición de este descargo se considere inválida, la aplicabilidad de las disposiciones restantes de este descargo no se verá afectada. في الأحداث أو البرامج غیر الربحیة.

.۱ التنازل والإعفاء: أنا المشارك \المشاركة، أفرج عن المنظمات غیر الربحیة وخلفائھا وأعفیھا إلى الأبد وأعزلھا من أي وجمیع

المسؤولیات والمطالبات والطلبات من أي نوع، سواء في القانون أو في الإنصاف، والتي تنشأ أو قد تنشأ فیما بعد من مشاركة طفلي في

أو الوفاة أو تلف الممتلكات أو غیرھا من المخاطر المرتبطة بھذه الأنشطة، وأنا أتحمل المسؤولیة الكاملة عن ذلك، بما في ذلك تلك

الناشئة عن السفر من وإلى ھذه الأنشطة. تشمل المخاطر المحددة على سبیل المثال لا الحصر: الغرق، لدغات الأفاعي، العمى الناتج عن

التعرض لعصارة بعض النباتات (الصقلب)، والتعرض لفیروس كورونا.

ً ً على أن ھذا الإذن یھدف إلى أن یكون واسع النطاق وشاملا كما تسمح بھ قوانین ولایة كالیفورنیا وأن ھذا
